1. The Service

JobSite Viewer is a project management and estimating platform for contractors. It includes tools for managing clients, projects, estimates, invoices, time tracking, and team management. Features vary by subscription plan.

2. Eligibility

You must be at least 18 years old and capable of entering a binding contract to use the Service. By using JobSite Viewer, you represent that you meet these requirements. The Service is intended for business use — not personal or consumer use.

3. Accounts

• You are responsible for keeping your account credentials secure.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when registering.
• One person or legal entity may not maintain more than one free account.
• Notify us immediately at support@jobsiteviewer.com if you suspect unauthorized access.

4. Subscriptions & Billing

• Paid plans are billed monthly or annually in advance via Stripe.
• You authorize us to charge your payment method on a recurring basis.
• Subscription fees are non-refundable except where required by law.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access until then.
• We reserve the right to change pricing with 30 days advance notice. Continued use after the notice period constitutes acceptance of new pricing.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Reverse engineer, decompile, or attempt to extract source code
• Resell, sublicense, or make the Service available to third parties without our written consent
• Upload or transmit malicious code, viruses, or harmful content
• Use automated means to scrape or harvest data from the Service
• Impersonate any person or entity

6. Your Data

You own your data. We do not claim ownership of any content you create or upload to the Service.

You grant us a limited license to store, process, and display your data solely as necessary to provide the Service.

You are responsible for ensuring that your use of the Service, and the data you enter, complies with applicable laws — including privacy laws governing your clients' information.

7. SMS Communications

By providing your mobile phone number during registration, you consent to receive SMS messages from JobSite Viewer for the following purposes:

• Verification codes (OTP) for account registration, login authentication, and password recovery
• Invoice payment alerts when a client pays an invoice
• Contract signature notifications when a client signs a proposal or contract
• Security alerts regarding suspicious account activity

8. Third-Party Integrations

The Service integrates with third-party platforms including QuickBooks (Intuit), Stripe, and others. Use of those integrations is subject to those providers' own terms of service. We are not responsible for the performance, availability, or conduct of third-party services.

9. Intellectual Property

The Service, including its software, design, templates, and content (excluding your data), is owned by Ayubzai Business Solutions LLC and protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

10. AI-Generated Content

JobSite Viewer includes AI-powered features including AI Quote generation, AI email drafting, AI contract generation, and AI template creation.

Your responsibilities:

• AI-generated content is provided as a starting point and must be reviewed and verified by you before use
• You are solely responsible for the accuracy of estimates, contracts, and communications sent to your clients, regardless of whether AI assistance was used in their creation
• AI-generated estimates are not guarantees of actual project costs
• AI-generated contract language does not constitute legal advice — consult a licensed attorney for legally binding agreements

Our responsibilities:

• We do not warrant that AI-generated content is accurate, complete, or suitable for your specific situation
• AI features are provided “as is” as a productivity tool only

11. API Access & Webhooks

JobSite Viewer provides API access (available on Business plan and above).

API Keys:

• Keep your API keys confidential — they grant full read/write access to your company data
• Do not embed API keys in public code repositories
• Revoke and regenerate keys immediately if compromised
• You are responsible for all activity performed using your API keys

Rate Limits:

API usage is subject to rate limits based on your subscription plan. Exceeding rate limits may result in temporary throttling.

Prohibited API Use:

You may not use the API to scrape data for competitive analysis, resell access to the API, or build products that compete with JobSite Viewer.

12. Data Processing & Client Privacy

As a contractor using JobSite Viewer, you collect and store information about your clients within the platform.

You are the data controller for your clients' personal information stored in JobSite Viewer. JobSite Viewer acts as a data processor on your behalf.

Your obligations:

• Obtain any necessary consent from your clients for collecting and storing their personal information in a third-party platform
• Comply with applicable privacy laws in your jurisdiction regarding client data
• Handle client data you collect through the platform responsibly and in accordance with your own privacy policy

CAN-SPAM Compliance:

When using JobSite Viewer's email marketing features to communicate with your contacts, you are responsible for:

• Having a legitimate basis to email each contact
• Including your physical business address in commercial emails
• Honoring opt-out/unsubscribe requests promptly
• Not using deceptive subject lines or sender information

JobSite Viewer's platform automatically includes unsubscribe links in broadcast emails to assist your compliance, but responsibility for legal compliance remains with you.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. Estimates, calculations, and project data generated by the Service are provided as tools to assist you — you are solely responsible for reviewing and verifying all outputs before presenting them to clients or using them for business decisions.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AYUBZAI BUSINESS SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify and hold harmless Ayubzai Business Solutions LLC, its officers, and employees from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

16. Termination

We may suspend or terminate your account at any time for violation of these Terms, non-payment, or conduct that we determine is harmful to the Service or other users.

You may terminate your account at any time by cancelling your subscription and contacting us at support@jobsiteviewer.com to request deletion.

17. Governing Law

These Terms are governed by the laws of the State of Nebraska, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Lancaster County, Nebraska.

18. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use after changes take effect constitutes acceptance.
